Elivoré does not operate a physical shop or public visitor location. Returns may not be delivered in person unless we have expressly agreed to this in writing.

Throughout these Terms, “Elivoré”, “we”, “us” and “our” refer to Elivore, trading as Elivoré. “Customer”, “you” and “your” refer to the person using our website or purchasing a product from us.

2. Applicability

These Terms apply to:

  • Your access to and use of our website.

  • All offers made through our website.

  • Every order placed with Elivoré.

  • Every agreement concluded between you and Elivoré.

Before placing an order, you will have the opportunity to review these Terms. By placing an order, you confirm that you accept them.

Mandatory consumer rights under applicable Dutch and European consumer law remain unaffected.

3. Website Use

You may use our website only for lawful, personal and non-commercial purposes.

You must not:

  • Misuse, disrupt or damage the website.

  • Attempt to gain unauthorised access to the website or related systems.

  • Upload or distribute malware or harmful code.

  • Scrape, copy or commercially exploit website content without permission.

  • Use the website to commit fraud or violate the rights of another person.

We may restrict access when reasonably necessary to protect our website, customers or business.

4. Products

We make reasonable efforts to display and describe our products as accurately as possible.

Colours and appearance may vary slightly depending on your screen, device settings, lighting and photography. Minor variations that do not affect the product’s essential characteristics are not considered defects.

Product measurements may have reasonable manufacturing tolerances. Relevant sizing information is provided on the product page or size guide.

Availability is limited and products may sell out. We may change or discontinue products before an order has been accepted.

5. Limited and Individually Numbered Products

Certain Elivoré releases may be produced in limited quantities and individually numbered.

Unless expressly stated on the product page, customers cannot select or request a particular individual number. A number will be assigned to the product during production or fulfilment.

The limited or individually numbered nature of a standard product does not remove any mandatory statutory cancellation, return or warranty rights.

Products that are genuinely personalised or made to a customer’s individual specifications may be excluded from the statutory right of withdrawal when permitted by law. Any such exclusion will be clearly communicated before purchase.

6. Prices

All prices displayed on the website are in euros and are total consumer prices, including VAT where applicable.

Shipping costs are not included unless expressly stated. Any applicable shipping costs are shown before you place your order.

For deliveries outside the European Union, import duties, customs charges or local taxes may apply. These charges are the customer’s responsibility unless expressly stated otherwise during checkout.

We may change prices at any time. A price change does not affect an order that we have already accepted.

If an obvious pricing or technical error occurs, we may contact you to correct the order or cancel it. If we cancel an order after payment, the amount paid will be refunded.

7. Placing an Order

To place an order, you must provide complete and accurate contact, billing, payment and delivery information.

An order submitted through our website is an offer to purchase the selected product. After placing an order, you will receive an electronic order confirmation.

The purchase agreement is concluded when we accept your order and send an order confirmation, unless the confirmation clearly states otherwise.

We may refuse or cancel an order for legitimate reasons, including:

  • Product unavailability.

  • An obvious price or product-information error.

  • Incomplete or incorrect customer information.

  • A failed or reversed payment.

  • Suspected fraud, misuse or unauthorised resale.

  • A delivery address that we cannot service.

If we cancel an order after payment has been received, we will refund the amount paid.

8. Payment

Available payment methods are displayed during checkout.

Payments are processed securely through Shopify and the payment providers offered at checkout. Elivoré does not directly store complete payment-card information.

You confirm that you are authorised to use the selected payment method and that the information you provide is accurate.

An order will not be dispatched until the required payment has been successfully received.

9. Order Changes and Cancellations Before Dispatch

Contact us as soon as possible at info@elivore.com if you notice an error or want to cancel an order.

We will try to accommodate changes or cancellations before dispatch, but we cannot guarantee this once fulfilment has started.

This section does not limit your statutory right of withdrawal after receiving the order.

10. Shipping and Delivery

Available destinations, delivery methods, estimated delivery times and shipping costs are displayed on our website or during checkout.

Delivery times are estimates unless we have expressly agreed to a guaranteed date. Unless another delivery period has been agreed, we will deliver an accepted order within the period required by applicable law.

We are not responsible for a delay caused by incorrect or incomplete delivery information supplied by the customer.

The risk of loss or damage passes to you when you, or a third party appointed by you other than the carrier, physically receives the products.

If a parcel appears damaged upon delivery, please photograph the packaging and products and contact us as soon as reasonably possible.

Further information is available in our Shipping Policy and Returns & Refunds Policy.

11. Right of Withdrawal

If you are a consumer in the European Union, you generally have the right to withdraw from an online purchase within 14 days without giving a reason.

The withdrawal period begins on the day you, or a third party appointed by you other than the carrier, physically receives the product. If one order is delivered in multiple shipments, the period begins when the final product or shipment is received.

To exercise this right, you must clearly inform us of your decision within the 14-day withdrawal period. You may use the online return form available through our Returns page, email us at info@elivore.com, or use the model withdrawal form included at the end of these Terms. Use of the online form is not mandatory.

If you submit your withdrawal through our online form, we will send you an acknowledgement by email without undue delay. Your withdrawal is effective when you clearly notify us within the withdrawal period; it does not depend on our approval.

After notifying us, you must return the product without undue delay and no later than 14 days after your notification.

12. Returns

To arrange a return, complete the online return form available through our Returns page or email info@elivore.com. Please provide your order number, name and the product you wish to return. A reason is optional for a standard withdrawal.

We review the submitted details only to determine the correct return route, for example a standard return or a damaged, defective or incorrect product. This review does not limit or replace your statutory right of withdrawal.

For a standard return, you may choose one of the following options:

  • Purchase a return label through Elivoré. We will send you an invoice or payment request showing the return-label cost. After payment, we will provide the return label and instructions.

  • Arrange and pay for your own tracked return shipment. We will provide the return address and necessary instructions.

You are not required to purchase a return label from Elivoré. Whichever method you choose, you are responsible for sending the product back within 14 days after notifying us of your withdrawal.

Unless the product is defective, incorrect or damaged upon arrival, the direct cost of returning the product is paid by the customer. Any return-label price charged by Elivoré will be shown before payment.

You may inspect and try on a product in the same way you reasonably would in a physical shop. You are responsible for any diminished value caused by handling beyond what is necessary to establish the product’s nature, characteristics and fit.

Returned clothing should not be worn beyond fitting, washed, altered, stained, damaged or exposed to strong odours. Original tags and packaging should be included where reasonably possible.

If a product is sold as one complete set, the full set must be returned to receive a refund for that product, unless mandatory law provides otherwise.

Not collecting or refusing a parcel does not automatically constitute a valid withdrawal. You must clearly notify us if you wish to withdraw from the purchase.

13. Refunds After Withdrawal

If you validly withdraw from the complete purchase, we will refund the payments received for the returned products, including the cost of our least expensive standard delivery option where required by law.

Additional costs resulting from choosing a more expensive delivery method are not refundable beyond the cost of the standard delivery option.

We will issue the refund without undue delay and no later than 14 days after receiving your withdrawal notice. We may withhold the refund until we have received the returned products or until you provide evidence that they have been sent back, whichever occurs first.

Refunds are made using the original payment method unless another method is expressly agreed.

If only part of an order is returned, the original delivery costs are generally not refunded unless required by law.

14. Incorrect, Damaged or Defective Products

We are responsible for supplying products that conform to the purchase agreement and meet the quality a customer may reasonably expect.

If you receive an incorrect, damaged or defective product, contact us at info@elivore.com and include:

  • Your order number.

  • A description of the problem.

  • Clear photographs where reasonably possible.

If a product does not conform to the agreement, you may be entitled to a free repair or replacement. If this is not possible or cannot reasonably be expected, you may be entitled to a price reduction or refund in accordance with applicable law.

Reasonable return costs for a confirmed incorrect, damaged or defective product will be covered by Elivoré.

Nothing in these Terms limits your statutory warranty rights.

15. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, validity periods and availability limits.

Unless expressly stated otherwise:

  • Discount codes cannot be exchanged for cash.

  • Only one discount code may be used per order.

  • Discount codes cannot be applied after an order has been placed.

  • Discounts do not apply to shipping costs.

  • We may refuse a discount obtained or used through fraud, technical manipulation or misuse.

Mandatory consumer rights remain unaffected.

16. Resale and Purchase Limits

Our products are intended primarily for personal use.

Where stated on the product page or during checkout, we may apply reasonable purchase limits to protect the availability of limited releases and prevent unauthorised commercial resale.

We may refuse or cancel orders that reasonably appear to evade purchase limits through multiple orders, identities, addresses or payment methods. Any payment received for a cancelled order will be refunded.

17. Intellectual Property

All content on the website, including the Elivoré name, logos, monograms, product designs, text, photographs, videos, graphics and layout, is owned by or licensed to Elivoré and is protected by applicable intellectual-property laws.

You may view the website for personal use. You may not reproduce, publish, modify, distribute, sell or commercially use our content without prior written permission.

No rights or licences are granted except as expressly stated in these Terms.

18. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including Shopify, payment providers, delivery companies, social-media platforms and WhatsApp.

Third parties operate under their own terms and privacy policies. We are not responsible for third-party websites or services outside our reasonable control.

19. Shopify

Our store is hosted by Shopify, which provides the ecommerce platform used to offer our products.

All sales made through this store are made directly between you and Elivoré. Shopify is not the seller of Elivoré products and is not responsible for fulfilling your order, processing your return or handling product-related complaints.

Use of personal information is explained in our Privacy Policy.

20. Availability of the Website

We aim to keep our website available and accurate, but we cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or modify the website for maintenance, security, technical or operational reasons.

Nothing in this section excludes liability that cannot legally be excluded.

21. Liability

Elivoré is liable where required by applicable law.

To the extent permitted by law, we are not liable for indirect or consequential business losses arising from a consumer’s use of the website or products.

Nothing in these Terms excludes or limits liability for:

  • Intentional misconduct or gross negligence.

  • Death or personal injury caused by negligence.

  • Fraud.

  • Supplying a product that does not conform to the agreement.

  • Any liability or consumer right that cannot legally be excluded or limited.

22. Events Outside Our Reasonable Control

We are not responsible for a failure or delay caused by circumstances outside our reasonable control, such as severe transport disruptions, natural disasters, government measures, war, civil unrest, widespread network failures or industrial disputes.

We will inform affected customers when reasonably possible and take reasonable steps to reduce the consequences.

Your mandatory cancellation, refund and consumer rights remain unaffected.

23. Complaints

If you have a complaint, please contact us first at info@elivore.com and include your order number where applicable.

We aim to acknowledge and handle complaints within a reasonable period.

If a complaint cannot be resolved directly, you may use any dispute-resolution or court procedure available to you under applicable law. Elivoré is not currently affiliated with a specific consumer arbitration board.

24. Privacy

We process personal information in accordance with our Privacy Policy and applicable data-protection law.

The Privacy Policy explains which information we collect, why we use it, how long we retain it and which rights you have.

25. Governing Law

These Terms and all purchase agreements with Elivoré are governed by Dutch law.

If you are a consumer living in another country, this choice of law does not remove any mandatory consumer protection provided by the law of your country of residence.

Disputes may be submitted to the competent court under applicable law.

26. Changes to These Terms

We may update these Terms to reflect changes to our business, website or applicable law.

The version that applied when you placed an order will continue to govern that order. Updated Terms apply only from the stated effective date and will be published on this page.

27. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

The invalid provision will be interpreted or replaced, where possible, in a way that most closely reflects its intended lawful purpose.
